Assault & Domestic Violence

Assault crimes and penalties in Ohio can range from a mere fine to significant prison time. For example, you may have been charged with disorderly conduct. This is recklessly engaging in fighting with another person. In most instances, disorderly conduct is punishable only with a fine. On the other hand, there is Felonious Assault. This is knowingly causing serious physical harm to somebody. Or it can also be merely attempting to cause physical harm to somebody with a weapon capable of inflicting death. Felonious assault charges carry stiff penalties, including up to 8 years in prison.

In-between Felonious assault and disorderly conduct there are several other assault crimes. These include:

  • Assault,
  • Domestic Violence, and
  • Aggravated Assault.

Generally, the difference in the crimes assault and felonious assault depends on the physical harm caused. Typically, if somebody suffers harm that would normally require some period of hospitalization, you likely will be charged with felonious assault. If the harm is simply bruising, scrapes, or minor cuts, you may be charged with assault. If the victim is a family or household member, it would be a domestic violence charge.

Domestic violence charges are complex. They affect where you are permitted to live and the ability to see your children. There are always two sides to the story. Many times the alleged victim's side is told to the police in a fit of anger. And, after time has lapsed, victims often change their story. The current facts told by the victim may be helpful to you as a defendant. Nevertheless, the prosecutor does not just drop the case. You need an experienced Ohio criminal defense lawyer to both defend you and to negotiate with the prosecutor to protect your interest.
